§1 Validity vis-à-vis entrepreneurs and definitions of terms
 

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his self-employed professional activity (§ 13 BGB).

§2 Conclusion of a contract, storage of the text of the contract

(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but are only non-binding invitations to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer submits a binding contract offer by successfully completing the order procedure provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired goods
2) Confirm by clicking on the "Order" buttons
3) Check the information in the shopping cart
4) Press the "Checkout" button
5) Registration in the online shop after registration and entering the login details (e-mail address and password).
6) Re-check or correction of the respective entered data.
7) Binding dispatch of the order by clicking on the button "order for a fee" or "buy"

Before the binding sending of the order, the consumer can return to the website on which the customer's data are recorded by pressing the "back" button contained in the Internet browser he uses, after checking his details, and correct input errors or cancel the order process by closing the Internet browser. We will confirm receipt of the order immediately by means of an automatically generated e-mail ("Order Confirmation"). We accept your offer with this.

(5) Storage of the contract text for orders via our online shop: We will send you the order data and our terms and conditions by e-mail. You can also view the terms and conditions at any time under https://www.anita-obermueller.com/agb. Your order data is no longer accessible via the Internet for security reasons.

§3 Prices, Payment, Due Date

(1) The prices quoted include 20%. VAT. In addition, there are any shipping costs.

(2) The consumer has the option of payment in advance, PayPal, credit card (Visa, Mastercard, American Express).

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.

 

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for shipment immediately. Delivery takes place within 5 working days at the latest. In the case of payment in advance, the period for delivery begins on the day after the payment order to the bank commissioned with the transfer and, in the case of all other payment methods, on the day after the conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item shall not pass to the buyer until the goods are handed over to the buyer, even in the case of mail order purchases.

§5 Retention of Title
 

We reserve title to the goods until the purchase price has been paid in full.

Consumers are entitled to a right of revocation in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his self-employed professional activity:

You have the right to withdraw from this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days, from the day of conclusion of the contract.

inform you of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail).

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
 

Consequences of revocation
 

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; in no case will you be charged any fees for this repayment.
 

If you have requested that the services should start during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.
